1. Acceptance
By accessing the Bowerbird website or platform you agree to these terms. If you don't agree, do not use our services.
2. Services
Bowerbird provides the Intelligent Protection Platform (IPP), takedown enforcement and related services. Specific scope, coverage and SLAs are defined in your subscription agreement.
3. Authorisation to act
By engaging Bowerbird, you grant a limited, revocable authorisation to file copyright-protection requests, DMCA notices, opt-outs and parity violation reports on behalf of the properties listed in your subscription. You retain ownership of all underlying intellectual property.
4. Acceptable use
You may not misuse the platform, attempt to breach security, reverse engineer, or use the services to file frivolous or unfounded complaints. We reserve the right to suspend abusive accounts.
5. Plans and payment
Subscriptions run on the term specified in your order (typically 12 months). Fees, setup fees and overage charges are billed under the order form. Late payment may suspend service.
6. Intellectual property
The Bowerbird platform, software, branding and content are owned by Bowerbird Technologies Pty Ltd and licensed, not sold. You retain all rights to your hotel imagery, brand assets and content.
7. Confidentiality
Both parties keep each other's non-public information confidential and use it only as needed to deliver the services.
8. Warranties & disclaimer
We provide the services with reasonable care and skill. Except as expressly stated, services are provided "as is" without warranty. We do not warrant a specific takedown outcome.
9. Liability
To the extent permitted by law, neither party is liable for indirect or consequential loss. Aggregate liability is capped at the fees paid in the prior 12 months.
10. Governing law
These terms are governed by the laws of Queensland, Australia, with non-exclusive jurisdiction in the courts of Queensland.
11. Changes
We may update these terms. Material changes will be notified by email or platform notice.
